Effective judicial protection in Euroepan law - The Role of the National Judge

Paris, 15-16 February 2010

mardi 8 décembre 2009, par Loïc Cadiet

Over the past 45 years, the European Court of Justice has developed several doctrines that aim at uniform and effective application of European law at national level. As partners in integration, it is the national courts’ task to apply, interpret and give effect to EU doctrines such as direct effect, consistent interpretation and the principle of effective judicial protection.

This seminar will discuss the role of the national judge in ensuring effectiveness of European law. The seminar should enable a debate on how European law is applied and enforced by national courts. The seminar is divided into three parts :

- The National Judge and the Effect of EU Law - National Procedural Autonomy and Effective Judicial Protection - Final discussion : Challenges for the National Judge in Providing an Effective Protection of European Law Rights http://www.era.int/cgi-bin/cms ?_SID=95ea945cf0119c5f6f946c9775ad2fb6502e36b100034249256021&_sprache=en&_bereich=artikel&_aktion=detail&idartikel=100772
